One of the most common sources for complaints we hear is from terminated employees who have looked at an online “severance calculator” after being laid off.

​After losing one’s job, one of the first questions to come to mind might be “how much severance am I entitled to?” or “how do I actually calculate my termination pay?” Although it would be wonderful if after being laid off, the employee could simply check a calculator to find out how much they are owed, this may result in the employee being seriously misled.

​The factors that go into calculating one’s severance can include length of service, age, salary, position etc. However, some of the other considerations that can have a dramatic impact on a severance calculation include:

  • Is my severance limited by my employment contract or offer of employment?
  • If my employer tried to limit my severance by contract, is their clause enforceable, or was the contract void all together?
  • Does the employer have cause for termination?
  • Is my wrongful dismissal severance pay impacted by my employment status (for example: frustration of contract, disability leaves, or independent vs dependent vs contractor status?)
